A Giant Teetering on the Brink

It’s a classic David vs. Goliath story.

For years a major household name in the video entertainment industry has been using this little company’s breakthrough technology in its gaming hardware products without paying a dime – while other companies that have embraced the technology, like Microsoft, Samsung, BMW, Logitech, Volkswagen and dozens of others, have either paid up or settled lawsuits long ago.

For legal reasons, I can’t reveal the name of this company in this letter, but it’s a name you know. So you can know the story – and better understand the enormous opportunity at hand – I’ll refer to it here as “Company X”.

Despite having a fraction of the cash and resources of a behemoth like Company X – this company refused to back down. It went after Company X hard, insisting the company recognize and pay a fair price for its patent-protected technology.

This tenacity appears to have paid off.

Ruling after ruling has supported its case. The initial lawsuit went in this company’s favor when the court ordered Company X to not only pay the company royalties on future gaming units sold, but also a $90 million cash settlement in back royalties and interest. Company X appealed, but things have not gone their way. Many of the arguments that serve as the basis for appeal have been dismissed by judges along the way.

But this most recent judgment may have been the backbreaker.

Company X had filed a motion 60b to challenge some of the company’s defenses during the trial. This motion, if granted, would have prolonged the appeals process and given Company X’s appeal credence. By denying the motion, many experts feel the Judge has basically skewered any hopes of a successful appeal by Company X.

Even more telling is that this ruling came days after a key ally and co-defendant in the case had said it will settle with this little company – agreeing to pay its share of the claim.  

And just weeks ago Company X suffered yet another legal setback when the U.S. patent office refused Company X’s request to re-examine this little company’s technology patents. In other words, the U.S. patent office is basically saying – this little company’s patents are rock solid… there’s no grounds of a challenge.  

Company X’s Options are Dwindling

Plus there’s this: Industry watchers are speculating that this legal battle is one of the main reasons Company X has yet to release its much-anticipated next generation gaming console, while Microsoft’s rival product – which also contains this company’s technology – has been available for several months. It’s impossible to estimate what the delay is costing Company X, but some estimate that it’s in the tens of millions of dollars – just in U.S. revenues alone.

No doubt, Company X’ lawyers and company officials have been pacing the floor, weighing their options. But the fact is, the recent judgment dramatically reduces their options… which is why many experts close to the case expect Company X to withdraw its appeal anytime now, accept the judgment and release the more than $90 million that’s been sitting in escrow awaiting the appeals ruling.

$90 Million Will Have an Enormous
Impact on this Stock

What kind of impact will a $90 million cash injection have on this company? It’s a little less than four times this company’s sales for all of 2005 – and represents about half the company’s market capitalization.

Plus, it means this costly legal battle is finally behind them and they can concentrate more of their resources on lining up new licensing agreements for their patented technology.

And then there’s this…

The $12 million to $20 million in royalties the company could get from Company X's current gaming products and the new gaming products coming onto the market in the months ahead.

It’ll also give this company’s patented technology an enormous amount of credibility and attention… and send a signal to other companies using it illegally: Settle up and pay up… or else.

Don’t think Wall Street isn’t watching. And don’t think they won’t be all over this stock the minute Company X caves and settles the suit.

That’s Why Time Is of The Essence

As an investor, you want to be in this play now – before the settlement is announced. Why? Because this is the kind of event that can send a stock soaring in a matter of days.

That 40% is your safety net. It means the stock can fall by nearly half and you can still make money. Meanwhile, if the stock goes up… your profits are even greater, since your net cost of the stock was less than market value. 

That’s precisely how we pulled in a quick 18% gain with the stock I’ve been telling you about…

Back when it was trading at $5.44 – and before we knew what we know now about this company’s legal situation – we recommended the stock… and immediately instructed subscribers to sell the November $5 call option, for which $1.20 was received. That means the net cost of the stock was $4.24. That means…

…If the stock closed anywhere above $5 – we’d see a nice 18% gain…

…If the stock were to fall $1.20 – we’d break even (while those who bought shares at full price lost 22%.)

…Even if the stock tanked we’re better off – because the $1.20 “safety net” built into the play dramatically reduced our downside risk!

So what happened? As we predicted, the stock moved higher. Our $5 option was called… and we walked away with a nice 18% gain in a couple months.

Symposium focus: Bioinformatics of networks

Bioinformatics of biological networks involves a range of interconnected multidisciplinary research topics. Research areas include the quantitative understanding of the dynamics of regulatory and metabolic networks by using modeling and simulation techniques, the reconstruction of biological pathways from experimental data, identification of pathway modules, the analysis and interpretation of experimental data in the context of biological networks, the construction and use of (public) pathway databases, network visualization and the development and use of pathway markup languages such as SBML and BioPax. Biological questions and new experimental techniques as well as ongoing (bio)informatics and statistics efforts will guide the development of the next generation of bioinformatics software packages. The combination of computational and genomics research will accelerate the detailed understanding of biological networks, which will find many applications in all application domains of life sciences.

Bridging the gap between disciplines

ISNB is specifically aimed at researchers working in life sciences, which includes disciplines like molecular biology, genomics, bioinformatics, biostatistics, informatics, computational life sciences and mathematical biology. Since more and more researchers are focusing on biological networks from different perspectives there is large interest in a dedicated symposium like the ISNB. ISNB provides a platform to bring together these different researchers in this field to exchange ideas and facilitate new national and international collaborations. Experience from ISNB2004 and ISNB2005 learns that there is a significant interest in this symposium. This symposium will also contribute to merge ideas and research from scientific programs in the field of bioinformatics, computational life sciences (e.g. simulation and modeling) and the experimental genomics work.

Scientific program and tutorial lectures

The Third International Symposium on Networks in Bioinformatics (ISNB 2006) is likely to continue its success from previous years by bringing together different disciplines to discuss ongoing research in this exiting field of biological networks and bioinformatics. In continuation of ISNB 2005 we aim to organize a three day meeting during which we will again schedule a mix of tutorial lectures and scientific presentations. The scientific program includes research and poster presentations from Dutch and international acknowledged researchers but also from young researchers starting in the field. The tutorial lectures provide an excellent opportunity to have well known researchers in the field give an introduction to junior and senior researchers and students who recently started working in related projects. The setup of the symposium facilitates sufficient possibilities to meet and talk to colleague researchers, which will facilitate many new and exciting collaborations and research projects.

ISNB and the Netherlands Bioinformatics Center (NBIC)

ISNB is part of ongoing initiatives of the Netherlands Bioinformatics Center (NBIC) to strengthen and promote bioinformatics research in the Netherlands. ISNB will feature Dutch bioinformatics researchers who are successful in the field of the bioinformatics of biological networks and who are support by the Dutch BioRange research program that is executed by NBIC.

ISNB as the leading “bioinformatics of biological networks symposium”

We specifically aim to give ISNB an internationally recognized and leading position. ISNB is unique as there are no other symposiums that are dedicated to the bioinformatics of biological networks. As part of this aim we try to motivate internationally leading researchers in this field to attend and present at ISNB. We expect that continuation of ISNB contributes to this goal and that the quality of this symposium increases every year. Again we aim for 175 participants.

Life sciences companies

More and more companies are active in the field of bioinformatics and computational life sciences. Several companies even have a focus on the development of pathway analysis software and databases for biologists and bioinformaticians. In several cases their products provided clear value. ISNB 2006 is again supported by several leading companies in the field of life sciences. Several commercial parties have been asked to present a scientific case to demonstrate how their product helps in advancing our understanding of biological networks.

How to Choose a Good Computer Username?

 

Pick a username and e-mail address that's easy to remember - for you and for others.
Steps:
1.  Choose a name that's easy to spell, type and remember.
 
2. Keep it simple and more or less free of special symbols.
 
3. If you'll be using the name to receive e-mail for professional purposes, stick with permutations of your name: mjones, yang36, monica_velasquez and so on.
 
4. Try "fun" names for a strictly personal account, but keep them short and sweet so people aren't misspelling them or forgetting them all the time: mamabear, cookiebaker and so on.
 
5. Use your ZIP code to add a number to your username, if you need to do so: smith60615 or ngo_90814, for example. (Some popular ISPs and free e-mail systems have so many subscribers that it's impossible to get your first choice of name, so they suggest adding a number to the end.) You'll remember it, at least, if no one else will.
 
6.  Avoid using profanity of any kind in your username. Many systems have an "autokill" function that will automatically and instantly terminate your account if it detects an inappropriate username. Review the system's terms of service for more information.

7.  NEVER USE WORD AS A PASSWORD. No such words that's found in Dictionary be used!

 

How safe is your password?

The first step in protecting your online privacy is creating a safe password - i.e. one that a computer program or persistent individual won't easily be able to guess in a short period of time. To help you choose a secure password, we've created a feature that lets you know visually how safe your password is as soon as you create it.

Tips for creating a secure password:
Include punctuation marks and/or numbers.
Mix capital and lowercase letters.
Include similar looking substitutions, such as the number zero for the letter 'O' or
'$' for the letter 'S'.
Create a unique acronym.
Include phonetic replacements, such as 'Luv 2 Laf' for 'Love to Laugh'.


Things to avoid:
Don't use a password that is listed as an example of how to pick a good
password.
Don't use a password that contains personal information (name, birth date, etc.)
Don't use words or acronyms that can be found in a dictionary.
Don't use keyboard patterns (asdf) or sequential numbers (1234).
Don't make your password all numbers, uppercase letters or lowercase letters.
Don't use repeating characters (aa11).
Tips for keeping your password secure:
Never tell your password to anyone (this includes significant others, roommates,
parrots, etc.).
Never write your password down.
Never send your password by email.
Periodically test your current password and change it to a new one.

Your Favorite Color is the Key to Your Sexual Life
The clothes you wear, your home furnishings and the car you drive all
give clues to your sexual personality. The key is the colors you
select for your possessions. Most people claim they haven't a favorite
color. But look around you, and you'll notice a pattern, especially in
your clothing and home decor. The predominant color for you is the one
that appears most frequently -- it's the one that mirrors the sexual
you. A panel of psychologists, speaking at the 1975 Home Interior
Design Forum, explained the association between color and sexual
patterns.
RED: People who like red tend to be tigers in the sack. They are
easily aroused and enjoy sex in every way imaginable. Once the sexual
spark is ignited, it may take hours to extinguish. When two reds get
together, the ensuing erotica could make Lady Chatterly blush. Lovers
of red tend to be aggressors and weaker colors should be aware.

YELLOW: If you tend to favor yellow, your sexual drives are complex
and turn toward the adaptable. The favorite color of homosexuals is
yellow. But don't panic -- not everyone who wears yellow is queer. In
most cases the person will consent to the stronger partner's desires
in a passive manner. You will never enjoy sex to the fullest, but you

PINK: Persons who like pink show a reluctance to mature in sexual
matters: women tend to tease, to promise more than they intend to
deliver. In some cases they flaunt their femininity -- but because

wardrobes in pink. Men who like pink are the philanderers and flirts.

BLACK: Black color preferences point to black sex (not necessarily

GREEN: Those who prefer green are fresh and innocent in their approach
to sex. Women who love green will always make love like virgins all
their life. And a man may always be a trifle clumsy and awkward but in
a charming and endearing sort of way. Green lovers are gentle, but not
passionate. If chosen as a mate, one will never need worry about
infidelity.

ORANGE: Lovers of the color orange lean toward sexual fantasies. The
sex act is regarded as a dramatic one-act play in which they are the
star. Foreplay is as important as the act of love. They whisper sweet
nothings, meaningless dialogue; they feel it is their image. Orange
people often do not experience orgasm -- but they put on a darn good
act. Men tend to pull their partner's hair, and women leave red welts
on the sex partner's back.

BROWN: If you love brown, you're a real treasure for the right mate.
Brown lovers tend to be warm and deep, sensitive to the needs and

grey spouse considers the other's infidelity a blessing. When a grey
marries another grey, the marriage is made in heaven.

BLUE: Lovers of blue are wonderful sex partners. They are sinners,

love making a fine art and their approach is elegant. Men who love
blue are like concert pianists, delicately ravaging their partner like
they would play a baby grand. Women in the blue category enjoy sex to
the fullest. They are exciting partners but their passion may be
compared to a tidal wave rather than fiery aggression. Both women and
men enjoy foreplay and the aftermath of lovemaking, as much as the sex
act itself. In marriage a blue person is a wonderful mate -- never
seeking outside interests.

Presented here are few exampli gratia <is it?> of number 11 and its association with things around. Especially the US woes over mankind of September 11. Must Read!!!!

1) New York City has 11 letters

2) Afghanistan has 11 letters.

3) Ramsin Yuseb (The terrorist who threatened to destroy the Twin Towers in 1993) has 11 letters.

This could be a mere coincidence, but this gets more interesting:

1) New York is the 11th state.

2) The first plane crashing against the Twin Towers was flight number 11.

4) Flight 77 which also hit Twin Towers, was carrying 65 passengers. 6+5 = 11

5) The tragedy was on September 11, or 9/11 as it is now known. 9 + 1+ 1 = 11

Sheer coincidence..?! Read on and make up your own mind:

It's the Time for 2GB hotmail

For more than 7 months Microsoft has been working to find complications related with the hotmail and its peripheral services. Though, Google is know to give its things @ Beta version, Microsoft has been following this trend of Googling for quite a large time. You may check out your gmail or related services including but not limited to the Google groups. The similar trend continues with the Yahoo Messenger and the MSN Messenger.

Now its time for the 2 GB hotmail account. Have you gotten one? Or should you write to me for invitation. The Live version of Microsoft services can be reached @ Live.com along with your customizable, RSS enriched home page. This is the ultimate outcome of Microsoft’s more than 7 month’s toil. De fact, they seem to fix well everything before the release of the newer Window’s version named Window’s Vista.

If you are still using your 2 MB hotmail, now the time has come to upgrade it to 2 GB. The trend in the hotmail history trace back to the not a completed decade of the top tier free email provider. Beginning with a 2 MB space, they provided a 250 MB for country specific, especially the US territories, and now the turn for 2 GB. However, the service is invitation only till the date. You can write to me for an invitation. This service is still under the beta testing and is more convenient to use like a customized outlook express where you have your own choice of color coded pages and enhancement. However, if you are still using your hotmail in you email client especially the Outlook Express, you might experience some connectivity problems with the server.

The new 8.0 version of the MSN Messenger is termed the Window’s Live Messenger /Messenger Beta and Live is encoded everywhere. Once you use it for now, you realize how many bugs are still remained to recover. The look however is realistic and more natural.

The more you use your single passport account to use Microsoft’s these services, the more proverbial you become. However, everything rest on us users whether to use 2.8 GB+ gmail, 1 GB Yahoo with increasing tech services or 2 GB enhanced hotmail. But how loving the word BETA seems with the developers?

On-Line Crash Analysis: An Overview

Background:

These days Online Crash Analysis has received a great attention both to the PC users including analysts and application manufacturers. Differentiations among software developer’s code must be one of the applicable reasons to that. Anyway whatever may causes be we shall talk to them later but now let’s walk thru concept behind OCA.

Wikipedia reports on OCA as ‘a service offered by application software or an operating system that reports details of a crash back to a central database using the internet’. In facts, information that is specifically vital to developers or the company which own the crashed software application is the behind-concept of OCA to resolve or to debug the failure issues with that application. Talked earlier those varying code concepts among developers, incompatibility among programs and hardware, continuous unsolved issues or non-updates pertaining with an application interfering that of another may be possible risks to online crash of the system. Users must be care enough to handle with cookies that error reports enable in your PC and other information that could be stored in your hard disk or shared with third party. Privacy is to be maintained in want of optimization and support.

Microsoft says to display Crash and Stop error reports to its clienteles on its website but nothing can be guaranteed on account of enhancement. You can view your OCA at Microsoft.com having your browser JavaScript and cookies enabled, for 180 days onward your error reports.

To sum up, every user must be sufficiently sentient to let manufacturers know just what have to. Besides, extremely differing variable application need not be installed without acknowledgement. Real solution to prevention application crash would bring a machine with intelligence.

Why is it that computers never have a "B" drive?

The answer to this question always tickle most of us, but Yahoo answers within so few lines and the simple answer is simples.

 

We found the answer to your question, along with several tangents on PC drive letters, on the discussion boards at StorageReview.com. This computer forum is exceptionally civil and informative.

The answer goes back to the glory days of floppy discs and DOS. The early DOS operating system designated two drives, A and B, strictly for floppy drives. Why? Because many early computers didn't have native hard drives -- they booted from Drive A, and ran applications from Drive B.

Later, as computers came with hard drives, the second floppy drive became a useless appendage -- the computer equivalent of an appendix. To avoid confusion during the evolutionary window when computers with new hard drives coexisted beside computers with two floppies, the hard drives were given the "C" slot.

Technically speaking, the "computer" isn't missing the B drive, it's just that later Microsoft operating systems have omitted it as unnecessary. You can read more about the ins and outs of archaic drive systems at Microsoft Support.
